Summary: Of the many obstacles to cross-border debt recovery, perhaps the most pressing is the lack of trust between national authorities in different EU Member States. National authorities publicly question and mistrust the enforcement of other Member States. The problem is exacerbated by the variety of pressure actions used by Member States, in particular their structure and nature. The aim of the project is to analyse these differences and to address the problems identified, in particular with a view to strengthening mutual trust.
Result to be achieved: The study will provide a comprehensive overview of the “enforcement” sub-policy on a national and comparative basis. It is important to explain in more detail the prerequisites for enforcement and to decouple enforcement from the finality of the decision (if possible). Studies of these two aspects are often marginalised or completely ignored in the doctrines of the respective national jurisdictions.
Achieved results: Mykolas Romeris University School of Law experts D. Bolzanas, R. Jokubauskas, M. Kirkutis, D. Višinskytė, V. Višinskis (working group manager Dr. D. Bolzanas) are actively participating in the project “Diversity of Enforcement Titles in Cross-border Debt Collection in the EU (EU-En4s)” supported by the European Commission for a few years (2019-2022). During the implementation of this Project, the above-mentioned legal experts participated in international expert meetings in Cyprus (Larnaca), Slovenia (Maribor), as well as in presentations and discussions on topical legal issues in online legal expert meetings in Albania (Tirana), Slovenia (Portorož) and in presentations. The experts involved in the project activities wrote a national report on debt recovery, filled in a questionnaire, organised meetings with judges and bailiffs to answer questions, wrote three separate scientific articles and one joint scientific article with Portuguese lawyers.
